These Terms of Service ("Terms") govern your access to and use of the mobile and web applications built and operated by Tribed LLC ("we," "us," or "Tribed") on the Tribed platform and distributed through Google Play and the Apple App Store (each, the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
01 Acceptance of these terms
By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and any additional guidelines or rules posted within the App. These Terms form a binding agreement between you and the developer. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
03 Eligibility and age
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the App. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian. By using the App, you represent that you meet these requirements and that the information you provide is accurate.
04 Your account
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You agree to provide accurate account information and to keep it up to date.
- Notify us promptly at [email protected] if you believe your account has been accessed without authorization.
- You may close your account at any time; see Termination and our data deletion process.
05 Acceptable use
When using the App, you agree not to:
- Break any applicable law, or infringe the rights of others.
- Post or share content that is unlawful, harassing, hateful, abusive, deceptive, or infringing.
- Upload malware, attempt to gain unauthorized access, or disrupt or interfere with the App or its infrastructure.
- Scrape, copy, or reverse-engineer the App except as permitted by law.
- Impersonate any person or misrepresent your affiliation with any person or entity.
- Use the App to send spam or unsolicited promotions to other members.
We may remove content or suspend accounts that violate these Terms.
06 Your content
You retain ownership of the posts, comments, messages, images, and other materials you submit inside the App ("Your Content"). By submitting Your Content, you grant the developer and the Creator a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it solely as needed to operate the App and deliver the community and features to you and other members. You are responsible for Your Content and represent that you have the rights necessary to share it.
07 Creator content
Programs, courses, plans, articles, audio, video, and other materials provided by the Creator ("Creator Content") are owned by the Creator or their licensors and are provided for your personal, non-commercial use within the App. You may not resell, redistribute, or publicly share Creator Content without permission. Creator Content is provided for informational and educational purposes and is not professional advice unless expressly stated.
08 Subscriptions and payments
Some features require a paid subscription or one-time purchase. Purchases made inside the App are processed by Apple (App Store) or Google (Google Play), and are subject to their terms. Where web checkout is offered, payments are processed by our payment provider.
- Subscriptions renew automatically until cancelled. You can manage or cancel a subscription in your Apple or Google account settings.
- Deleting your in-app account does not automatically cancel a store subscription — cancel it directly through the store.
- Except where required by law or store policy, payments are non-refundable. Refund requests for store purchases are handled by Apple or Google.
- Prices and features may change; we will give notice of material changes where required.
09 Third-party services
The App relies on third-party services to deliver certain features, including cloud hosting and infrastructure providers, AI providers (OpenAI and ElevenLabs) for chat and voice features, YouTube API Services for optional video publishing, and Apple Health or Android Health Connect for optional wellness features. Your use of these features is also subject to those providers' terms, and how we handle the associated data is described in our Privacy Policy. We are not responsible for third-party services we do not control.
10 Connecting social accounts
The App may let you connect a third-party social account, including YouTube or TikTok, so that content you create can be prepared and sent to that account. If you connect a social account:
- You authorize the App to access and use that account only for the features you enable, such as authenticating you and uploading content you choose to publish.
- Tribed's YouTube integration uses YouTube API Services. By using Tribed and its YouTube integration, you agree to be bound by the YouTube Terms of Service.
- For a YouTube upload, you select the connected channel, provide or approve the title and description, choose a visibility setting offered by YouTube, and expressly start the upload or choose its schedule. Tribed does not alter those choices without your consent.
- You represent that you own or have all permissions necessary to upload and publish the selected media, and you remain responsible for the content and metadata sent to the connected platform.
- Content sent to TikTok is delivered to your TikTok account as a draft for you to review and publish within TikTok; you remain responsible for what you finally post.
- Your use of the connected platform is governed by that platform's own terms and policies, and you agree to comply with them.
- You can disconnect a linked social account at any time in the App or revoke access in the connected platform's settings. YouTube access can also be revoked in Google security settings. See the YouTube API Services section of our Privacy Policy for data use and deletion details.
11 Intellectual property
The App, the Tribed platform, and all associated software, design, and trademarks are owned by the developer or its licensors and are protected by intellectual-property laws. Except for the limited right to use the App under these Terms, no rights are granted to you. You may not use our names, logos, or branding without prior written permission.
12 Health and wellness disclaimer
Some Apps include fitness, nutrition, sleep, mindfulness, or other wellness content. This content is for general informational and educational purposes only and is not medical advice. It is not intended to diagnose, treat, cure, or prevent any condition, and it is not a substitute for professional medical guidance.
Always consult a qualified healthcare professional before starting any exercise, nutrition, or wellness program, especially if you have a medical condition, are pregnant, or take medication. You use wellness features at your own risk.
13 Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any content or advice provided through it will meet your expectations or produce any particular result.
14 Limitation of liability
To the maximum extent permitted by law, the developer and the Creator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. To the extent liability cannot be excluded, our total liability for any claim relating to the App is limited to the greater of the amount you paid for the App in the twelve months before the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15 Indemnification
You agree to indemnify and hold harmless the developer, the Creator, and their affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, Your Content, or your violation of these Terms or the rights of any third party.
16 Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the App. On termination, the rights granted to you under these Terms end, while provisions that by their nature should survive — such as intellectual property, disclaimers, limitation of liability, and indemnification — continue to apply. 17 Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the revised Terms.
18 Governing law
These Terms are governed by the laws applicable at the developer's place of residence, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. Nothing in these Terms limits any rights you may have as a consumer that cannot be waived under applicable law.
